Opportunity Scholarship Update

The North Carolina Supreme Court, on September 2, dismissed a request from legislative leaders and parents to temporarily reinstate North Carolina’s Opportunity Scholarship program while a lawsuit makes its way through the courts. The good news is that the high court dismissed the emergency motion “without prejudice.” This means that school choice proponents can re-file the case with the North Carolina Court of Appeals, asking for a stay of Superior Court Judge Robert Hobgood’s August 25 ruling that struck down the program and permanently enjoined the State from dispersing any funds for Opportunity Scholarships. Prior to Judge Hobgood’s ruling, Opportunity Scholarship grants had been awarded to nearly 2,000 lower income students to attend private schools, but funds had not been distributed. If a stay is granted, the Opportunity Scholarship program may be allowed to proceed for this school year.
